Terms of Service

These terms apply to all products and services provided by Daniel Norris, including mobile apps on the Apple App Store, themes and modules on the HubSpot Asset Marketplace, the website at danielnorris.com, and consulting services.

Acceptance of Terms

By using any product or service provided by Daniel Norris, you agree to these terms. If you do not agree, do not use the product or service.

HubSpot Marketplace Products

Themes and modules listed on the HubSpot Asset Marketplace are provided for use within the HubSpot platform. When you install a theme or module, you receive a license to use it on the HubSpot account where it is installed. You may not redistribute, resell, or repackage any theme or module as your own product.

Themes and modules are designed to work with standard HubSpot functionality. Compatibility with third-party integrations, custom code, or heavily modified HubSpot environments is not guaranteed. Minor customization is expected and encouraged through the built-in editor settings provided with each product.

Themes include page templates, module components, and default styling. Installing a theme does not include custom design work, content migration, or setup assistance unless purchased separately as a consulting service.

Mobile Apps

Mobile apps published on the Apple App Store are subject to Apple's standard terms in addition to these terms.

Consulting Services

Consulting services are provided under a separate agreement between Daniel Norris and the client. These terms apply to the general relationship. Specific scope, deliverables, timelines, and fees are defined in individual proposals or statements of work.

Intellectual Property

All products, themes, modules, templates, code, designs, and content created by Daniel Norris remain the intellectual property of Daniel Norris unless explicitly transferred in writing as part of a consulting engagement.

For consulting work, deliverables created specifically for a client become the property of the client upon full payment, unless otherwise stated in the project agreement.

Support

Support for Marketplace themes and modules is provided on a reasonable-effort basis. Questions can be directed to contact@danielnorris.com. Response times are not guaranteed but most inquiries are addressed within a few business days.

Support covers questions about built-in settings and standard functionality. It does not cover custom code modifications, third-party integration troubleshooting, or HubSpot platform issues outside the scope of the product.

Support for consulting engagements is defined within the scope of the specific project agreement.

Refunds

Free themes and modules have no associated charges and therefore no refund applies.

For paid products, refund requests can be submitted within 30 days of purchase by contacting contact@danielnorris.com. Refunds are evaluated on a case-by-case basis.

Consulting services are billed according to the terms in each project agreement. Refund terms for consulting are defined in those agreements.

Availability and Updates

Products, themes, and modules may be updated, modified, or discontinued at any time. Reasonable effort will be made to maintain compatibility with current HubSpot platform versions. There is no obligation to provide updates indefinitely.

Limitation of Liability

Products and services are provided "as is" without warranties of any kind, express or implied. Daniel Norris is not liable for any indirect, incidental, or consequential damages arising from the use of any product or service.

Total liability for any claim related to a product or service is limited to the amount you paid for that specific product or service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold Daniel Norris harmless from any claims, damages, or expenses arising from your use of any product or service in a way that violates these terms or applicable law.

Governing Law

These terms are governed by the laws of the State of Hawaii, United States.

Changes to These Terms

These terms may be updated from time to time. The revised version will be posted at this URL with an updated date. Continued use of any product or service after changes are posted constitutes acceptance of the updated terms.
